1. Definitions

In these Terms and Conditions:

• "Telok Marine", "we", "us", "our" refers to Telok Marine, registered in Singapore, with offices at 6 Raffles Boulevard, #03-128, Marina Square, Singapore 039594.
• "Guest", "you", "your" refers to any individual or group engaging our services or using our website.
• "Charter" refers to any of our three published yacht charter services: Midday Leisure Sail, Cultural Heritage Cruise, or Luxury Multi-Day Passage.
• "Booking" refers to a confirmed reservation for a charter, secured by payment of a deposit.
• "Agreement" refers to these Terms and Conditions together with any specific booking confirmation provided to you.

2. Acceptance of Terms

By using our website or making a charter booking, you confirm that you are at least 18 years of age and have the legal capacity to enter into a binding agreement. If you are booking on behalf of a group, you accept these terms on behalf of all members of that group and are responsible for communicating these terms to them.

3. Service Description

Telok Marine operates yacht charter services from Marina at Keppel Bay, Singapore. Our three charters — Midday Leisure Sail, Cultural Heritage Cruise, and Luxury Multi-Day Passage — are described on our website. Inclusions, capacity, duration, and pricing are as published at the time of booking.

All charters are subject to availability and to prevailing sea and weather conditions. The captain holds authority over all decisions relating to the safety and conduct of the voyage.

4. Booking and Payment

Confirmation

A charter is confirmed only upon receipt of a deposit as specified in the booking confirmation. Enquiries do not constitute a reservation. We will send booking confirmation to the email address provided upon receipt of your deposit.

Balance

The remaining balance is due prior to departure as specified in your booking confirmation. Failure to pay the balance by the specified date may result in cancellation of the booking.

Pricing

All prices are quoted in Singapore Dollars (SGD) and include the inclusions listed for each charter. Prices are subject to change; the price confirmed at the time of booking applies to that booking.

5. Cancellation and Rescheduling

By the Guest

• Cancellations made more than 14 days before the charter date: deposit is refundable at our discretion, or the booking may be rescheduled without penalty.
• Cancellations made 7–14 days before the charter date: deposit is forfeited; rescheduling is available subject to availability.
• Cancellations made within 7 days of the charter date: deposit and any balance paid are forfeited unless the cancellation is due to circumstances beyond the guest's reasonable control.

By Telok Marine

We reserve the right to cancel or reschedule a charter due to unsafe or unsuitable sea conditions, mechanical issues requiring urgent attention, or other circumstances beyond our reasonable control. In such cases, guests will be offered an alternative date or a full refund of amounts paid.

6. Guest Responsibilities

• Guests must follow all safety briefings and instructions given by the captain and crew.
• Guests must inform us in advance of any medical conditions, dietary requirements, or mobility limitations that may affect their safety or experience.
• Guests must not bring prohibited substances on board. Excessive alcohol consumption that poses a risk to safety is grounds for return to port.
• Guests are responsible for their personal belongings on board. Telok Marine accepts no liability for lost or damaged personal items.
• Children must be supervised at all times by a responsible adult.

7. Prohibited Activities

• Smoking below deck or in any designated non-smoking area
• Use of illegal substances
• Behaviour that endangers the safety of other guests or crew
• Tampering with navigation, safety, or mechanical equipment
• Entering restricted areas of the vessel without crew permission

8. Intellectual Property

All content on our website — including text, photographs, logos, and design elements — is the property of Telok Marine or its licensors. You may not reproduce, distribute, or use this content for commercial purposes without prior written consent.

9. Disclaimers

Our charters are provided in good faith based on prevailing conditions. We do not commit to specific outcomes such as wildlife sightings, particular weather conditions, or identical experiences to those described in marketing materials. Sea conditions are variable and itineraries may be adjusted accordingly.

10. Limitation of Liability

To the fullest extent permitted by Singapore law, Telok Marine's liability to you in connection with any charter shall not exceed the amount paid by you for that specific charter. We are not liable for indirect, incidental, or consequential losses, including loss of enjoyment or lost business opportunity.

Nothing in these terms limits our liability for death or personal injury caused by our negligence, or for any liability that cannot be excluded by law.

11. Indemnification

You agree to indemnify Telok Marine against any claims, losses, or expenses arising from your breach of these terms, your negligent or unlawful conduct on board, or claims brought by other members of your group in connection with conduct attributable to you.

12. Termination

We may terminate a charter early and return to port if guest behaviour poses a safety risk, if sea or weather conditions deteriorate beyond acceptable thresholds, or if these terms are materially breached. No refund will be issued where early termination results from guest conduct in breach of these terms.

13. Dispute Resolution

These terms are governed by the laws of Singapore. In the event of a dispute, we encourage you to contact us at [email protected] in the first instance so that we may attempt to resolve the matter informally. If informal resolution is unsuccessful, disputes shall be submitted to the exclusive jurisdiction of the Singapore courts.

14. General Provisions

These terms, together with any booking confirmation, constitute the entire agreement between you and Telok Marine in relation to your charter. If any provision of these terms is found to be unenforceable, it shall be severed and the remaining provisions shall continue in full force. Our failure to enforce any right does not constitute a waiver of that right.

15. Changes to Terms

We may update these terms from time to time. The version in effect at the time of your booking will apply to that booking. Continued use of our website after any update constitutes acceptance of the revised terms.
